During the design phase for these projects, the power output of the entire plant is calculated and then a guarantee is issued as part of the contract. Failure to meet these guarantees typically lead to expensive liquidated damage claims and complex disputes.
There are numerous factors that impact the ability of a solar PV plant to produce power at a certain level. Ultimately, these factors decide whether the plant is able to deliver on the PRGs in the contract or not.
